| از پایان جنگ جهانی دوم، زمانی که منشور سازمان ملل متحد و اعلامیه جهانی حقوق بشر به تصویب رسید، مجموعهای از اسناد بینالمللی حقوق بشر به زنان اشارههای خاص یا کلی داشت. کنوانسیون رفع همه اشکال تبعیض علیه زنان از این جمله هستند. سؤالات پژوهش این است که منظور از حمایت از حقوق زنان چیست و این مفهوم در فقه مذاهب اسلامی و اسناد بینالمللی چگونه تبیین شده و به چه تعارضاتی منجر شده است؟ در این پژوهش که به روش توصیفی – تحلیلی صورت گرفته است، کنوانسیون رفع تبعیض علیه زنان به طور دقیق مورد مطالعه قرار گرفت و مهمترین ابعاد آن با فقه مذاهب اسلامی تطبیق داده شده است. یافتههای پژوهش نشان میدهد که حقوق زنان در هریک از ابعاد حیات فردی (بلوغ، تبرج، تبیین)، حیات خانوادگی (ازدواج، طلاق، رجوع، ارث) و حیات اجتماعی (پوشش، اشتغال، زن به عنوان شاهد و زن به عنوان ذیحق) در فقه مذاهب اسلامی با مواد کنوانسیون رفع تبعیض علیه زنان دارای تعارض است. | ||

| Since the end of World War II, when the United Nations Charter and the Universal Declaration of Human Rights were adopted, a series of international human rights instruments have made specific or general references to women. The Convention on the Elimination of All Forms of Discrimination against Women is one of these. The research questions are, what is meant by the protection of women's rights and how is this concept explained in the jurisprudence of Islamic religions and international documents and what conflicts has it led to? In this research, which was carried out using a descriptive-analytical method, the Convention on Elimination of Discrimination against Women was studied in detail and its most important aspects were adapted to the jurisprudence of Islamic religions. The findings of the research show that women's rights in each dimension of individual life (maturity, maturity, explanation), family life (marriage, divorce, recourse, inheritance) and social life (coverage, employment, women as witnesses and women as beneficiaries) In the jurisprudence of Islamic religions, there is a conflict with the articles of the Convention on the Elimination of Discrimination against Women. | ||
