| چکیده | ||
| در آیه 21 سوره روم، مودت و رحمت به عنوان قوام بخش روابط زن و مرد دانسته شده که در خلقت تکوینی انسان قرار داده شده است. دانشمندان علوم اسلامی ضمن آیه مذکور بیشتر به بیان روابط زن و مرد در زوجیت اعتباری پرداخته‌اند و توجه کمتری نسبت به روابط زن و مرد در زوجیت تکوینی مستنبط از آیه مذکور مبذول داشته اند. لذا پژوهش حاضر با گردآوری مطالب به صورت کتابخانه‌ای و با استفاده از روش توصیفی _ تحلیلی، به بیان احکام فقهی روابط زن و مرد در زوجیت تکوینی و ارتباط آن با آیه 21 سوره روم پرداخته است. طبق بررسی های انجام شده و با بیان مفردات آیه مذکور، مبنای مودت و رحمت میان زن و مرد خلقت تکوینی بر اساس زوجیت است نه صرف زوجیت اعتباری؛ بلکه عاملی که باعث وصول زن و مرد به سکونت است، زوجیت اعتباری در سایه تعهداتی است که زوجین نسبت به هم با عقد ازدواج به آن‌ها متعهد می گردند. بر اساس واقعیت طرح شده در آیه مذکور، می توان یکی از حکمت ها و کارکردهای مهم برخی احکام فقهی مربوط به روابط زن و مرد از جمله عدم نگاه، عدم خلوت، عدم طنازی کردن در سخن، عدم اختلاط و داشتن ستر و حجاب را تاثیر عدم رعایت این احکام در ایجاد مودت و رحمت بین زن و مرد نامحرم و مفاسد ایجاد شده در پی آن دانست. در طرف مقابل، مستنبط از آیه شریفه، تحکیم خانواده نیز بر اساس وجود فطرت و غریزه نهاده شده در خلقت انسان و تاثیر مودت و رحمت میان زن و مرد است و کارکرد آرام بخشی خانواده از این رهگذر تامین خواهد شد. | ||

| In verse 21 of Surah Ar-Rum, affection and mercy are considered the foundation of the relationship between man and woman, which is embedded in the natural creation of humans. Islamic scholars have mostly focused on the legal aspects of the relationship between man and woman in contractual marriage, paying less attention to the inherent relationship derived from this verse. Therefore, this study, using a descriptive-analytical method and library research, examines the jurisprudential rulings on the inherent relationship between man and woman and its connection to verse 21 of Surah Ar-Rum. According to the conducted studies and the explanation of the terms in this verse, the basis of affection and mercy between man and woman is the natural creation based on inherent marriage, not merely contractual marriage. The factor that leads to tranquility between man and woman is the contractual marriage under the commitments they make to each other through the marriage contract. Based on the reality presented in this verse, one of the important wisdoms and functions of some jurisprudential rulings related to the relationship between man and woman, such as avoiding gaze, seclusion, flirtation in speech, mixing, and maintaining covering and hijab, is the impact of not observing these rulings on creating affection and mercy between non-mahram men and women and the resulting corruption. Conversely, derived from the noble verse, the strengthening of the family is also based on the inherent nature and instinct placed in human creation and the impact of affection and mercy between man and woman, and the calming function of the family will be ensured through this | ||
