| چکیده | ||
| خانواده به دلیل ایفای نقشی بیمانند و تعیین کننده در تحقق آرمانهای جمهوری اسلامی ایران، از جایگاه ارزشی ممتازی برخوردار است. با این وجود ، موقعیت خانواده در جامعه ایرانی در مقایسه با شاخص های خانواده طراز، در حد انتظار نیست. آمارهای رسمی از طلاق و تزلزل روابط همسری نگران کننده است، در حالی که از سالها پیش تاکنون آمار ازدواج رو به کاستی است. توزیع متغیرهای حقوق اجتماعی زنان و خانواده در برنامههای توسعه علیرغم تأکید قانون اساسی بهصورت نظاممند، پیوسته، راهبردی و مبتنی بر اصول حاکم بر خانواده مورد توجه قرار نگرفتهاست و این امر نشاندهنده آن است که برنامهریزان به خوبی نتوانستهاند برش عملیاتی از قانون اساسی را با رهیافت حقوق شهروندی در برنامههای توسعه تنظـیم کننـد. برای اینکه حرکت نظام اسلامی به سمت ایجاد جامعهای خانوادهمحور و تقویت و تحکیم خانواده معطوف شود، باید کارکردهای اصلی آن بر پایه الگوی اسلامی خانواده، بهعنوان مرکز نشو و نما و تربیت اسلامی فرزند و کانون آرامشبخش تنظیم شود. لذا لازم است که اصل تحکیم خانواده در رأس اصول صیانت از خانواده مبنای رویکرد قانونگذاران و قوه قضائیه به نظام حقوق خانواده قرار گیرد. در این پژوهش سعی میشود تا با روش توصیفی-تحلیلی، میزان انطباق اصول حاکم بر خانواده و آموزههای حقوقی اسلام با اصول قانوناساسی و برنامههای توسعه کشور بررسی شده و مبانی فقهی و حقوقی آن به شیوه توصیفی تحلیلی مورد نقد و واکاوی قرار گیرد و خلأها و نواقص و کاستیها شناسایی و راهکارهای برون رفت از آن در جهت اصلاح قوانین و برنامههای توسعه به ویژه برنامه هفتم ارائه گردد. | ||

| The family has a privileged position due to its unique and decisive role in realizing the ideals of the Islamic Republic of Iran. Nevertheless, the position of the family in Iranian society is not as expected compared to the indicators of the model family. The official statistics of divorce and marital breakdown are worrying, while the marriage statistics have been declining for years. The distribution of the variables of social rights of women and family in the development plans, despite the emphasis of the constitution, has not been taken into account in a systematic, continuous, strategic and based on the principles governing the family, and this indicates that the planners have not been able to properly cut the operational section of the constitution with the approach Regulate citizen rights in development plans. In order for the movement of the Islamic system to be directed towards creating a family-oriented society and strengthening and consolidating the family, its main functions should be adjusted based on the Islamic model of the family, as a center for the Islamic upbringing and education of children and a center of relaxation. Therefore, it is necessary that the principle of family consolidation should be the basis of the approach of the legislators and the judiciary to the family law system. In this research, an attempt is made to examine the conformity of the principles governing the family and legal teachings of Islam with the constitutional principles and development programs of the country, and its jurisprudential and legal foundations are criticized and analyzed in a descriptive and analytical way and the gaps, defects and shortcomings should be identified and solutions should be provided in order to amend the laws and development plans, especially the 7th plan. | ||
